Purchase, Sale, Sublease and Use of Apartments

  • All apartment sales are subject to approval by the Board of Directors.
  • Anyone moving from or into apartments must have their move-in date approved at least 72 hours in advance by the Managing Agent. All movers must obtain insurance in favor of the Lessor and a certificate of insurance must be provided to the Managing Agent or Superintendent prior to the move date.  Move hours are Monday through Friday between 9 a.m. and 5 p.m. or Saturday between 9 a.m. and 4 p.m.  A $1,000 deposit must be given to the Managing Agent at the time the move-in date is approved by the Managing Agent to cover the cost of any damages to common areas of the building that might result from such move; such deposit less the cost of any damages, if any, will be returned to the Lessee promptly after the move. All deliveries are to be delivered through the Service Entrance located on the East Side of the building down two flights of stairs through the basement and up in one of the Service Elevators.
  • Apartments are for the occupancy by shareholders or Board approved sub-lessees only.  Shareholders or Board approved sub-lessees may not have guests occupy their apartment unless such shareholder or sub-lessee is in residence in the building; i.e., is not out of town.  Any shareholder desiring to sublet his or her apartment is responsible for paying a sublet fee to the Lessor.

Construction or Renovation of Apartments

  • No apartment construction or renovations shall be permitted without completion of an alteration agreement (which can be obtained from the Managing Agent), approval by the Board of Directors, and the written approval of the Managing Agent.  In addition, all apartment construction or renovations must comply with applicable New York City building codes and regulations. At the Lessee’s discretion, certain proposed construction or renovations may be reviewed by independent engineers, architects or other consultants at the Lessee’s expense.  Painting, floor sanding and changes in cabinetry that do not require changes to the existing plumbing or electrical service do not constitute renovations that require prior approval for these purposes.
  • The Corporation requires that all Shareholders intending to have alteration work performed, must complete and submit an alteration agreement in advance. No work shall start prior to written approval issued by the Managing Agent.  Painting, floor refinishing, and carpet cleaning require advance notice and approval by the building Superintendent prior to scheduling by the Shareholder.  This will prevent foreseeable conflicts with and among corporation projects/contractors and Shareholder workmen.  Please consult the Managing Agent with any additional questions.
  • All apartment construction or renovations, including painting, floor sanding and changes in cabinetry, is limited to Monday through Friday between 9 a.m. and 5 p.m.] and Saturday between 9 a.m. and 4 p.m. Service Elevators are closed between 12 p.m. and 1 p.m..  All contractors, subcontractors and other tradesmen must obtain customary insurance for the benefit of the Lessor and provide a certificate of such insurance to the Managing Agent prior to the commencement of any construction or renovations. The Building is closed for all bank holidays. Please consult with the Managing Agent regarding when the holiday is is being observed.
  • Any contractors, tradesmen, vendors or other outside parties who are working in our building should be closely supervised by the Lessee to insure the safety of the building and compliance with the House Rules.  It is not the responsibility of the Superintendent or building staff to supervise such persons.

Security

  • Please secure all stairwell gates to the lobby when using to insure our collective safety.
  • When no doorman is on duty, please make sure that the front door locks completely when you close it. Please carry your front door key at all times as the front door is locked at all times and the
  • All food deliveries (or similar cash on delivery transactions) must be handled by you while our elevator operator waits for the completion of the transaction and escorts the delivery person back to the main floor.
  • Please make arrangements in writing to the Superintendent or elevator operator that you are expecting parcels to be delivered ort picked up and use the package room for storage instead of leaving your keys with the elevator operator.

Access to Apartments

  • Paragraph 25 of the Proprietary Lease requires Shareholder/Residents to leave a complete set of duplicate keys to their apartment with the Superintendent to be kept in a lock box for building emergencies only.  If you have not already done so, please provide the superintendent with a duplicate set of keys. If you have not provided the keys and a building emergency situation arises when you are not at home to give access for repair, the Superintendent has the right to force the door to your apartment to open to gain access.  You will be responsible for any damage caused by this forcible entry.  In addition, you will be responsible for any additional damage to other apartments or to the building which may result from the delay in gaining entry to your apartment. A building emergency consists of, but is not limited to, a water or gas leak, a fire or electrical mishap. Being locked out of one's apartment does not constitute a building emergency, nor does access for contractors, deliveries or installations.
  • All tenant/shareholders are requested to observe the following rules designed to protect you.
  • Where keys are not on file with the Superintendent and your key is needed on a specific day for maintenance repairs, tenants will be asked to put their keys in a sealed envelope and place them in a locked box in the Superintendent’s office, with a note identifying ownership, and instructions that the keys should be returned at the end of the day to the owner.  Should you choose to leave your keys and not be present while work or repairs are being done, the Corporation accepts no liability for this accommodation.
  • Shareholders/Residents may leave their apartment keys at the front desk for the day only.  Keys are NOT to be left overnight.  Please hand your keys to the doorman and do not leave them on the desk unnoticed. Please supply the doorman with only the applicable keys; do not leave a ring of keys.  If you leave them with the doorman in an envelope, please put only your name on the envelope and not your apartment number.  Please note that the Corporation uses a number system to register and log in your keys in the drawer for the day and not a name system. EXCEPTION: Shareholders who are selling or renting their apartments and have a signed contract with a real estate broker may leave the keys  with the front desk.
  • If your apartment is being shown by a real estate broker between the hours of 9 and 5, please make arrangements in writing to our Superintendent with names and dates.  If the appointment is scheduled after five o’clock, please make arrangements to be at home.  Please make every effort when listing your apartment with brokers to be very specific as to visitation times so as not to inconvenience your neighbors.

Storage, Bicycle and Laundry Rooms

  • The public halls and stairways of the building shall not be obstructed or used for any purpose other than ingress to and egress from the apartments in the building.  The fire towers shall not be obstructed in any way.
  • Lessees who decide to store items of any nature in the storage room or bicycle room do so at their own risk.  The Lessor is not responsible for the theft, loss or any damages to any items stored in such rooms or in any other common areas of the building.
  • All Shareholders who wish to use the bicycle room in the basement must tag and hang their bicycles after every use.  Bicycles not properly hung and tagged may be discarded at any time without liability to the Corporation.
  • Lessees may use the Laundry Room facilities only upon such days and during such hours as may be designated by the Lessor or the Managing Agent. Hours of Operation: 9 AM to 11 PM – 7 days a week.  All other hours the Laundry Room will be locked. Last wash must be in the washer by 9:30 pm. The Laundry Room is for the exclusive use of residents and their staff.  Do not leave clothes in the washer and dryer after the cycle is finished. Upon completion of the wash cycle, place the clothes in a dryer or remove them from the Laundry Room. Upon completion of the dryer cycle remove the clothes from the Laundry Room. No clothes are allowed to be left in the Laundry Room overnight. The staff will remove and plastic bag any items, wet or dry, at closing time. The items will be held for two days and then will be thrown out. Contact the Superintendent the next day for the held items. The machines are for clothes only. Do not wash or dry any oversized or heavy items in the machines, such as small area rugs, athletic shoes and large comforters. Please use a commercial laundry for oversized items. The laundry carts are not to be removed from the Laundry Room under any circumstances and nothing is to be placed in the carts except clothing being laundered.  Please read and follow all the instructions posted in the Laundry Room regarding operation of the machines. While the Staff cleans and monitors the Laundry Room daily, it is the user’s responsibility to remove all lint from the dryer lint tray prior to commencing the cycle. Also, please do your best to keep the tables, machines and sink clean. No pets, food or drinks are permitted in the Laundry Room. All young children must be supervised constantly by an adult. No children are to be left unattended or are to leave the Laundry Room unsupervised. Please report any washer, dryer or money machine malfunction to the Staff or Service Directions. All Service Direction’s contact information is posted in the Laundry Room. Failure to follow these rules may result in a loss of your use of the Laundry Room.
  • The Lessor shall have the right from time to time to curtail or relocate any space devoted to the storage, bicycle or Laundry Rooms.
  • Storage bins are located in the basement and available to Shareholders on an “as available” basis.  A monthly charge will appear on the maintenance bill for any storage bins utilized by any Shareholder.  Please note that property of any kind found on, adjacent to or leaning against storage bins or in public halls, including apartment entry halls, stairwells or other areas, is not permitted and is a Fire Code violation.  Such property may be discarded at any time without additional or specific notice of liability to the Lessor.
  • Clothes washing machines and dryers are not permitted in any apartment.  A laundry room is provided in the basement for all residents.

Use of the Passenger and Freight Elevators and Deliveries

  • The passenger and service elevators shall be operated only by employees of the Lessor, and there shall be no interference whatsoever with the same by Lessees or members of their families or their guests, employees or subtenants.
  • Removal or return of furniture, appliances, or any large item requiring the use of the service elevator shall be done with prior approval of the Superintendent, and arranged for during the hours of 9 a.m. and 5 p.m., Monday through Saturday.  This rule also applies to contractor’s arriving and leaving with supplies. An insurance certificate must be presented to the Managing Agent as per the specifications required.
  • Only baggage or other personal possessions that readily fit on the luggage cart may be taken in or out of the building through the lobby and transported in the passenger elevator.  All other baggage and large pieces of furniture or other items shall be taken in or out of the building through the service entrance and transported on the freight elevator.  No dollies shall be transported through the lobby.
  • No bicycles, scooters, or similar vehicles shall be allowed in a passenger elevator when the service elevator is manned.
  • No workmen or trades peoples are to use the passenger elevator at any time unless the freight elevator is not in service in which case such persons may use the passenger elevator with the approval of the Superintendent.
  • Messengers and trades people shall use such means of building ingress and egress as shall be designates by the Lessor or Superintendent.
  • Parcels, groceries, dry cleaning, take-out (convenience) food, and Parcel Post packages may be delivered through the lobby.  The passenger elevator may be used for such deliveries when the service elevator is not manned.  No other deliveries whatsoever, except as permitted in writing by Management, are permitted through the lobby and passenger elevator.
  • Anyone moving from or into apartments must have their move-in date approved at least 72 hours in advance by the Management Agent to allow for the scheduling of the passenger elevator. Insurance Certificate requirements must be met.

Required and Courteous Consideration of other Residents

  • Smoking is prohibited by New York City law in all common areas of the building, including the elevators, lobby and laundry room.
  • Children shall not play in the public halls, lobby, stairways, fire towers or elevators.  Children shall not be allowed in any area of the basement unsupervised.
  • No Lessee shall make or permit any distributing noises in the building or do or permit anything to be done therein which will interfere with the rights, comfort, or convenience of other Lessees.  No Lessee shall play upon or allow to be played upon any musical instrument, stereo, radio or television in such Lessee’s apartment if the same shall disturb or annoy other occupants of the building.  No construction or repair or other installation involving noise shall be conducted in any apartment except on Monday through Friday and only between the hours of 8 a.m. and 5 p.m. or on Saturday between the hours of 9 a.m. and 5 p.m. (including legal holidays).
  • No public hall above the ground of the building shall be decorated or furnished by any Lessee in any manner without the prior consent of all of the Lessees to whose apartments such hall serves as a means of ingress and egress; and without prior consent of the Lessor.
  • Unless expressly authorized by the Lessor in each case, the floor of each apartment must be covered with rugs or carpeting or equally effective noise reducing material, or the extent of at least eighty percent (80%) of the floor area in each room excepting only kitchens, pantries, bathrooms, maid’s room, closets and foyer.

Required and Safe Use of Public Areas

  • No article shall be placed in the halls or on the staircase landings or fire towers, nor shall anything be hung or shaken from the doors, windows, terraces, or balconies or placed upon the window sills of the building.
  • Shareholders are responsible for removing from the building all unwanted furniture, appliances, fixtures, beds, boxes, enclosures and packing, materials.  If Shareholders require assistance with the removal of any of these items, they should contact the Superintendent.  The Corporation will require the payment of $50.00 per item for costs incurred in the in the removal of such item(s).  This same charge will apply to any items found in the public halls or stairwells.  These charges will appear on your monthly statement.  This money will be used to defray costs of removal from the building.
  • All fire doors have to be kept closed at all times.
  • Baby carriages, bicycles or other personal belongings shall not be allowed to stand in the public halls, passageways, areas, or courts of the building.  No gas-motorized vehicle shall be allowed on the premises under any circumstances.
  • No window air conditioning units, awnings, or ventilators shall be used in or about the building or other part of the building, except such as shall have been approved by the Lessor or the Managing Agent.
  • No radio or television aerial shall be attached to or hung from the exterior of the building without prior written approval of the Lessor or the Managing Agent.
  • No sign, notice advertisement, or illumination shall be inscribed or exposed on or at any window or other part of the building, except such as shall have been approved by the Lessor or the Managing Agent.
  • No Lessee shall install any plantings on the terrace, balcony, or roof without the prior written approval of the Lessor.
  • The roof of the building shall not be used or walked upon by the Lessees of the building for recreational purposes.
  • Garbage and refuse from apartments shall be disposed of only at times and in such manner as the Managing Agent of the building shall direct.  Garbage has to be bagged in heavy plastic bags and properly closed to avoid roach and rodent infestation.  Recyclable items should be segregated from other garbage and placed in the recycle bins located in the stairwell or other public hallways on each floor.
  • Bathrooms and other plumbing apparatus in the building shall not be used for any purpose other than those for which they are constructed, not shall any sweepings, rubbish, rags, kitty litter, or any other article be thrown into the bathrooms.  The cost of repairing any damage resulting from misuse of any bathroom or other plumbing apparatus shall be paid for by the Lessee in whose apartment it shall have been caused.
  • No Lessee shall send any employee of the Lessor out of the building on any private business of a Lessee under any circumstances.
  • Complaints regarding the service of the building shall be made in writing to the Managing Agent.
  • In no event shall dogs be permitted in elevators or in any of the public portions of the building unless carried or on a leash.  In addition, all shareholders and sub-lessees must abide by applicable New must abide by applicable New York City and State leash and litter laws and regulations.  No birds or other animals shall be fed from the window sills, terraces, balconies, or in the yard, court spaces or other public portions to the building.  Any damage done to the premises by an animal shall be paid for by the owner of the animal.
  • No group tour or exhibition of any apartment or its contents shall be conducted, nor shall any auction sale be held in any apartment without the consent of the Lessor or its Managing Agent.
  • The agents of the Lessor, and any contractor or workman authorized by the Lessor, may enter any apartment at any reasonable hour of the day for the purpose of inspecting such apartment to ascertain whether measures are necessary or desirable to control or exterminate any vermin, insects, or other pests and for the purpose of taking such measures as may be necessary to control or exterminate any such vermin, insects or other pests.  If the Lessor takes measures to control or exterminate carpet beetles, the cost thereof shall be payable by the Lessee.
  • No patient of any doctor who has offices in the building shall be permitted to wait in the lobby.

Conditions of House Rules

  • Any consent or approval given under these House Rules by the Lessor shall be revocable at any time.
  • These House Rules may be added to, amended, or repealed any time by resolution of the Board of Directors of the Lessor.
